Welcome to PayoutJet!
Thanks for trusting us to help with your insurance claim. These Terms of Service ("Terms") cover your use of our website, AI tools, and reports.
We wrote this to be as clear as possible. We want you to understand exactly what we do (provide tools to help you prepare and organize information for self-directed negotiations) and what we don't do (act as your lawyer or insurer).
By creating an account or using PayoutJet, you agree to these Terms. You also represent that you are at least 18 years of age and legally capable of entering into binding contracts. Your use of PayoutJet is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. If you don't agree, that's okay, but you can't use our services.
1. What We Do (and Don't Do)
We are a technology company, not a law firm.
We provide tools: We use software and AI to help you organize data and estimate potential claim values.
You are the "Pro Se" Representative: This means you are representing yourself. You make the final decisions on what to say to an insurance company and what settlement to accept.
No Professional Advice: PayoutJet is a self-help tool. No attorney-client relationship is created by using this site. The generated reports are strictly templates based on your inputs. We do not provide legal strategy, assess the legal merits of your claim, or represent you in communication with insurers. Our reports are informational resources, not legal advice or USPAP-compliant appraisals.
2. How Our AI Works (Your Role as Editor)
We use advanced Artificial Intelligence (AI) to draft reports for you. Like any AI, it can sometimes "hallucinate"—which means it might sound confident but be factually wrong.
Trust but Verify: Think of our AI as a helpful assistant who prepares a first draft. You are the editor-in-chief. You promise to review every number and fact in your report before you send it to anyone.
Your Responsibility: Because you have the chance to edit the report, you accept full responsibility for its accuracy. PayoutJet isn't liable if the AI, for example, makes a math error, hallucinates comparable vehicle (comp) information, or suggests a value that an insurer rejects.
3. Account & Security
Be Honest: You agree to provide accurate information about your accident and vehicle. Using our tools to create fraudulent documents is strictly prohibited.
Keep it Safe: Keep your login details private. You are responsible for what happens on your account.
4. Payments & Refunds
Fees: Prices are displayed at checkout. You authorize us (and our processor, Stripe) to charge the payment method you provide.
Money-Back Guarantee: We want you to be satisfied. Our refund rules are simple and fair—please read our Refund Policy to see if you qualify.
Chargebacks: If you have an issue, please email [email protected] first. We are usually very reasonable! If you file a chargeback with your bank instead of asking for a refund, we may suspend your account to resolve the dispute.
5. Intellectual Property & Data Usage
Our Stuff: We own the software, the designs, and the AI models.
Your Stuff: You own the specific data you upload (like your repair bill). You give us permission to host that data to generate your report.
License to Improve AI: By using our services, you grant PayoutJet a non-exclusive, perpetual, royalty-free license to use anonymized or aggregated data derived from your documents and interactions to improve our services and train our AI models. This helps us make PayoutJet smarter for everyone.
Personal License: When you buy a report, we give you a license to use it for your personal claim. Please don't resell it, post it publicly, or use it to train other AI systems.
6. Prohibited Activities
To keep PayoutJet safe for everyone, you agree not to:
- Use our tools for fraud or illegal acts.
- "Scrape" our website or try to reverse-engineer our software.
- Share your account with others to avoid paying fees.
7. Disputes: Let's Talk First
We prefer to fix problems, not fight in court.
Step 1: The "Cool Down" Period. If you have a legal issue with us, you agree to email [email protected] and give us 60 days to resolve it informally.
Step 2: Arbitration. If we can't fix it after 60 days, we both agree to resolve the dispute through individual arbitration in Summit County, Utah (or Small Claims court). This is generally faster and cheaper than a lawsuit.
No Class Actions. You agree to resolve disputes on an individual basis. You waive the right to join a class action lawsuit against us.
Exceptions: If someone is hacking our site, committing fraud, or stealing intellectual property, we can go straight to court to stop it immediately.
8. Mass Filings (The "Bellwether" Protocol)
If a law firm tries to file many similar arbitration claims against us at once (a "Mass Filing"), we agree to a fair process to avoid wasting money on fees:
- We will process 10 "Test Cases" first (5 picked by you/your counsel, 5 picked by us).
- All other cases will be paused (with no fees charged) until those test cases are resolved.
This ensures we can establish a fair outcome without bankrupting the process with administrative fees.
9. DISCLAIMERS
Please read this section carefully. It explains that our services are "As Is."
THE SERVICES ARE PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYOUTJET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.
NO GUARANTEES: WE DO NOT GUARANTEE THAT YOU WILL RECEIVE ANY PAYOUT FROM AN INSURER. CLAIM OUTCOMES DEPEND ON MANY FACTORS OUTSIDE OUR CONTROL.
ESTIMATES ONLY: THE VALUES IN OUR REPORTS ARE ESTIMATES FOR NEGOTIATION. THEY ARE NOT PROMISES OF PAYMENT.
10. LIMITATION OF LIABILITY
Because our services are affordable, we cannot accept unlimited liability.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYOUTJET'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS SHALL NOT EXCEED THE GREATER OF: (A) $100 USD; OR (B) THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS.
WE ARE NOT LIABLE FOR INDIRECT DAMAGES, SUCH AS LOST CLAIM VALUE, REJECTED SETTLEMENTS, OR DATA LOSS, EVEN IF WE WERE ADVISED OF THE POSSIBILITY.
11. Indemnification
If you use our services to do something illegal, or if you alter a report and get sued by a third party, you agree to defend and indemnify PayoutJet against those claims.
12. Termination
We reserve the right to suspend or terminate your access to PayoutJet at any time, with or without cause. We will provide you with reasonable notice of such termination via email, except where notice is prohibited by law or required to protect the security of the Services. If we terminate your account without cause, we will refund a prorated portion of any unused service fees.
13. General Terms
Severability: If any part of these Terms is found to be unenforceable or invalid, that part will be ignored, but the rest of the Terms will remain in full force and effect.
Service Interruptions: Sometimes things happen that are out of our control (like internet outages, AWS going down, or natural disasters). We aren't liable if the Services are unavailable due to these events.
Updates: We may update these Terms. If we make big changes, we'll let you know.
Utah Law: These terms are governed by the laws of the State of Utah.
